Tailor-Made Solutions For Your Future As A New Family
At our law firm, we believe that providing comprehensive legal solutions and avoiding unnecessary conflicts is one of the keys to reaching favorable agreements. We are seasoned mediators and trial lawyers prepared to make every effort to protect you and your child’s rights.
In order to determine all aspects of child custody (now known as Allocation of Parental Responsibilities), the law requires each parent to draft a parenting plan to be submitted to the other parent. Parenting plans must include provisions for both parenting time and decision-making which can be either shared or sole. The two proposed parenting plans serve as the basis for negotiations of a settlement which is known as an Allocation Judgment. Resolution of parenting time issues can affect the amount of child support paid.
If parents cannot agree on a plan, then the court will make a decision based on best interests criteria, including:
- The child’s historical primary care provider
- The relationship with each parent
- A parent’s ability and will to facilitate an ongoing relationship with the other parent
- The ability of each parent to meet the physical, mental health and emotional needs of the child
- The history of domestic violence or abuse, if any
Your Allocation Judgment is a living document that should adapt to your current needs as a family. Our services also include guidance and representation to modify your plan. As your lawyers, we are ready to guide you through the legal system, explain your rights and protect your child.
